RESOLUTION to Add Title 5, Chapter 5 to the San Leandro Administrative Code, Establishing Sunset Provisions for Incomplete and Inactive Planning Applications

 

Body

WHEREAS, the California Permit Streamlining Act establishes criteria for the review and processing of development applications under Government Code Section 65920 et seq.; and

 

WHEREAS, it is in the interest of the City of San Leandro to responsibly analyze land use and development proposals to ensure that the City is planned and developed in in an orderly and sustainable manner; and

 

WHEREAS, it is in the interest of the City of San Leandro to promptly and efficiently process every application; and

 

WHEREAS, Article 21 Section 5-2102 of the San Leandro Zoning Code directs that “The Zoning Enforcement Official shall adopt administrative procedures for the reasonable processing of zoning permits and other zoning actions.”; and

 

WHEREAS, these application provisions enable the City to reasonably address applications that are abandoned and remain incomplete or inactive for an extended period of time; and

 

WHEREAS, the addition of Title 5, Chapter 5 to the San Leandro Administrative Code is set forth in the attached Exhibit A, incorporated herein by reference.

 

NOW, THEREFORE, THE CITY COUNCIL FOR THE CITY OF SAN LEANDRO HEREBY RESOLVES THAT:

 

1.                     The above recitals are true and correct and made a part of this resolution.

2.                     That the addition of Title 5, Chapter 5, to the San Leandro Administrative Code, as set forth in the attached Exhibit A, is hereby approved and the application processing criteria described therein is authorized.
