RESOLUTION Authorizing the City Manager to Execute a Standard Public Improvement Agreement with San Leandro Senior Associates, LP, for Public Improvements on Carpentier Street

Body
WHEREAS, the City approved Site Plan Review PLN2008-00030 at 1400 San Leandro Boulevard with Bridge Housing Corporation (as applicant) and Bay Area Rapid Transit District (as property owner) that permits the development of a two phase affordable housing project; and

WHEREAS, the Conditions of Approval for said Site Plan Review require the applicant to construct certain public improvements, and

WHEREAS, a Standard Public Improvement Agreement between the City of San Leandro and San Leandro Senior Associates, LP, a copy of which is attached, was presented to this City Council to assure construction of public improvements; and

WHEREAS, said agreement conforms to San Leandro Municipal Code Section 7-1-945 et seq., and

WHEREAS, said agreement is guaranteed by a Faithful Performance Bond and a Labor and Materials Bond issued by International Fidelity Insurance Company, each in the amount of $133,391.50; and

WHEREAS, the City Council is familiar with the contents thereof; and

WHEREAS, the City Manager recommends approval of said agreement and acceptance of said bonds.

NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:

1. That the Standard Public Improvement Agreement between the City of San Leandro and San Leandro Senior Associates, LP, substantially in the form presented is hereby approved and execution by the City Manager is hereby authorized; and

2. That the City Manager is authorized to make non-substantial revisions to said agreement, subject to the approval of the City Attorney; and

3. That an original executed agreement shall be attached to and made a part of this resolution, and
