RESOLUTION to Authorize the City Manager to Enter into a Lease Agreement with East Bay Municipal Utility District (EBMUD) for Chabot Park (provides for the general maintenance of Chabot Park, tree maintenance, and implementation of a Tree Hazard Evaluation Plan) and for City Council Appropriation Approval of $154,000 to Fund the Lease Agreement Requirements using the 2017-18 General Fund Economic Uncertainty Reserves

 

 

Body

WHEREAS, an agreement between the City of San Leandro and East Bay Municipal Utility District (EBMUD), a copy of which is attached, was presented to this City Council; and

 

WHEREAS, the City Council is familiar with the terms of the agreement; and

 

WHEREAS, the City Manager recommends approval of said agreement.

 

NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:

 

1.                     That said agreement in an amount not to exceed $4,000 per year, plus 3.5% annual adjustment is hereby approved; and

 

2.                     That the terms of the agreement will be memorialized in writing by the City Manager, subject to the approval of the City Attorney; and

 

3.                     That the City Manager is authorized to execute said agreement; and

 

4.                     That an original executed agreement shall be provided to the City Clerk, and be attached to and made a part of this resolution.

 

5.                     That the City Council approves an appropriation of $154,000 to fund the lease agreement requirements using the 2017-18 General Fund Economic Uncertainty Reserves ($150,000 in 010-33-001 and $4,000 in 010-61-019-5630).
