RESOLUTION to Authorize the City Manager to Enter into an Agreement with the Bay Area Air Quality Management District to Receive Grant Funding from the Transportation Fund for Clean Air to Install 9.5 Miles of Bikeways for the Bicycle Network West, Project No. 2014.0430

WHEREAS, the City of San Leandro (the City) submitted an application to the Bay Area Air Quality Management District (the Air District) for the Transportation Fund for Clean Air (TFCA) Regional Funds to be used for the Bicycle Network West Project, Project No. 2014.0430 (the Project), in the adopted Capital Improvement Program; and

WHEREAS, On October 4, 2017, the Air District Board of Directors approved grant funding awards for the TFCA Program for Fiscal Year Ending 2017, and authorized its Executive Officer/Air Pollution Control Officer to execute grant agreements with project sponsors; and

WHEREAS, to receive the awarded $139,128 in grant funds, the City, as a project sponsor, must execute the TFCA Funding Agreement (the Agreement) between the Air District and City of San Leandro, Project Number 17R21, and must abide by the terms, conditions, insurance, and recordkeeping requirements; and

WHEREAS, the Agreement requires a minimum $48,372 local funding match that the City will provide from $250,000 in Measure BB funds previously appropriated for the Project in the adopted Capital Improvement Program; and

WHEREAS, the City must implement the Project within two years, and must maintain the improvements for at least 7-years following completion.

NOW, THEREFORE, BE IT RESOLVED that the City Manager is hereby authorized to accept grant funding in the amount of $139,128 and execute the Agreement, in substantive form attached hereto as Exhibit A, in a form approved by the City Attorney, and undertake such actions as may be necessary or appropriate to carry out and implement the terms of the Agreement and intent of this...
