Body
WHEREAS, an agreement between the City of San Leandro and Noll & Tam Architects, a copy of which is attached, was presented to this City Council; and

WHEREAS, the cost associated with the Mulford-Marina Branch Library shall be reimbursed to the City's General Fund upon issuance of proposed lease revenue bonds in FY 18-19; and

WHEREAS, the City Council is familiar with the scope of work; and

WHEREAS, the City Manager recommends approval of said agreement.

NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:

That said agreement substantially in the form presented is hereby approved and execution by the City Manager is hereby authorized; and

That the City Manager is authorized to make non-substantial revisions to said agreement, subject to the approval of the City Attorney; and

That the City Manager or his designee is authorized to negotiate and approve individual contract amendments up to a maximum of $32,527, which is 10% of the original contract amount; and

That the City Manager or his designee is authorized to negotiate and approve cumulative contract amendments up to a maximum of $81,318, which is 25% of the original contract amount, for a total not to exceed amount of $406,590.
