Staffreport

SUMMARY AND RECOMMENDATIONS

This project reconstructed 4.2 lane miles of pavement throughout the City, including upgrades to 27 curb ramps to comply with Americans with Disabilities Act (ADA) requirements.

 

Staff recommends the City Council take the following actions:

                     Accept the work; 

                     Direct staff to File the Notice of Completion; and

                     Authorize the City Manager to release the performance and payment bonds, and to release the maintenance bonds for the subject project upon successful completion of the one-year maintenance period.

 

BACKGROUND

Each year the City completes pavement maintenance projects: Street sealing and street overlay/rehabilitation. This staff report is for the Annual Overlay/Rehabilitation 2016-17 Project Phase 1.

 

On July 17, 2017, by Resolution No. 2017-112, the City Council awarded a construction contract to DeSilva Gates Construction, L.P. for the subject project. The contract completed repairs, reconstruction, and/or overlay on a total of 4.2 lane miles of pavement on six City streets segments, including upgrades to 27 curb ramps within the project’s limits to bring them into compliance with ADA requirements.

 

In addition to the reconstruction of pavement, the contract reconfigured San Leandro Boulevard from San Leandro Creek to West Broadmoor Boulevard by removing one vehicle lane in each direction and adding buffers to the bike lanes. This change supports the City’s Complete Streets Policy towards access for all roadway users.

 

This contract included installation of rubberized pavement on Teagarden Street between Alvarado Street and 1000 ft. north of Alvarado Street. The performance of this material will be evaluated over the next few years and if found acceptable, the material will be incorporated into future projects. Rubberized pavement involves adding rubber crumbs, obtained from recycled tires that would have been dumped in landfill, to asphalt concrete during manufacturing. Records submitted by the contractor indicated that 22,983 Ibs of rubber crumbs were used on this project, resulting in diversion of an equivalent of 1,915 passenger tires from landfill. In March 2016, the California Department of Resources Recycling and Recovery (CalRecycle) awarded grant funds to the City for the cost differential between conventional asphalt concrete and rubberized asphalt concrete used on the job.

 

The contract also installed six new speed cushions on Castro Street and 136th Avenue at locations requested and approved by a majority of the residents as part of the 2015-16 Neighborhood Traffic Calming Program.

 

Analysis

 

Construction is now complete and was performed in compliance with the contract documents.

 

This contract was performed under the Community Workforce Agreement (CWA), which established the Alameda County Building and Construction Trades Council and its affiliated labor unions as the sole bargaining representative of all persons working on City construction projects valued above $1,000,000. The CWA sets a goal of 30% participation by San Leandro residents and if no San Leandro residents are available, then Alameda County residents. Contractors are required to make good faith efforts to reach this goal through the utilization of the Unions' hiring hall procedures. The agreement also requires the contractor to hire one San Leandro resident, or if not available, an Alameda County resident, as a new apprentice for the first $1 million of the bid amount.

 

The contractor on this project accomplished the following towards meeting the CWA’s Local Hire goals:

Although the contractor did not achieve the goal of San Leandro residents performing 30% of the total 6,933 hours, it was not due to their inaction. DeSilva Gates made good faith efforts to reach this goal through the utilization of union hiring hall procedures to request journeyman and apprentice level San Leandro resident workers. Robust economic conditions and their effects on the labor market severely limited the contractor’s ability to hire local residents to work on this project.  However, in seeking to hire residents of Alameda County, the contractor met both the 30% journeyman and 10% apprenticeship goals.

 

Current Agency Policies

 

                     Maintain and enhance the City’s infrastructure.

                     Support and implement programs, activities and strengthen communication that enhances the quality of life and wellness, celebrates the arts and diversity and promotes civic pride.

 

Previous Actions

 

                     On November 20, 2017, by Resolution No. 2017-165, the City Council authorized increasing the scope and fee of WRECO’s contract to include pedestrian and safety features on San Leandro Blvd.

                     On July 17, 2017, by Resolution No. 2017-112, the City Council awarded the construction contract to DeSilva Gates Construction, L.P. for the Annual Overlay / Rehabilitation 2016 - 17 Project, Project No. 2017.0050; authorized the City Manager to negotiate and approve individual change orders up to 4% of the original contract amount; and authorized the City Manager to negotiate and approve cumulative change orders up to 12% of the original contract amount.

                     On November 21, 2016, by Resolution No. 2016-157, the City Council authorized the City Manager to submit applications for the CalRecycle Rubberized Pavement Grant Program.

                     On November 7, 2016, by Resolution No. 2016-142, the City Council approved a contract with WRECO for the design of the subject project.

 

Applicable General Plan Policies

 

                     Transportation Goal T-2: Design and operate streets to be safe, attractive, and accessible for all transportation users whether they are pedestrians, bicyclist, transit riders or motorists, regardless of age or ability.

                     Transportation Goal T-3: Promote and accommodate alternative, environmentally-friendly methods of transportation, such as walking and bicycling.

                     Transportation Goal T-5: Improve major transportation arteries for circulation in and around the city.

                     Transportation Goal T-7: Improve traffic safety and reduce the potential for accidents on San Leandro streets.

 

Environmental Review

 

This project is categorically exempt from the California Environmental Quality Act (CEQA) per Section 15301(c) of the CEQA guidelines.  The Notice of Exemption was filed with the Alameda County Recorder on March 24, 2017.

 

Summary of Public Outreach Efforts

 

                     The Notice to Bidders was published in the Daily Review, the South County Post, Visión Hispana and the World Journal. 

                     Staff also notified twenty-one builders’ exchanges and construction data firms as well as a list of contractors that asked to be notified of bidding opportunities via email.

                     The project is described on the Engineering and Transportation Department website.

                     Two mandatory pre-bid meetings were held on June 6 and June 13, 2017.  The intent of these meetings was to inform bidders of the project details including the City’s Local Inclusion Ordinance and Community Workforce Agreement.

                     On September 5, 2017, the proposed street diet scheme for San Leandro Boulevard was presented at the City Council meeting.

                     A neighborhood meeting was held on September 27, 2017 regarding the street diet scheme proposed for San Leandro Boulevard.

 

Fiscal Impacts

 

The original estimated cost of phase 1 of the Annual Street Overlay / Rehabilitation 2016-17 project was $3,239,963 when presented to City Council on July 17, 2017.  The total actual cost of phase 1 is $3,920,092, which includes design, construction contract and construction administration.
