SUMMARY AND RECOMMENDATIONS

Staff recommends that the City Council approve an amendment to the legal services agreement with Meyers Nave of $130,000 for legal costs incurred in FY 17-18.

BACKGROUND and ANALYSIS

Due to an anomalous increase in the need for legal services during fiscal year 2017-2018, including but not limited to attorneys' fees to negotiate the settlement of Heron Bay Homeowners Association v. City of San Leandro (Real Party in Interest Halus Power Systems), First District Court of Appeal, Case No. A143985 and the accompanying drafts of loan documents and deeds of trust for Halus Power Systems to repay and provide a deed of trust on Halus' real property as security for payment of petitioner's attorneys' fees owed, to coordinate and advise the City Council upon the investigation of allegations of improper conduct by the City Manager, to advise staff on implementation and interpretation of the tobacco retailers license ordinance, to advise staff related to the revamp and subsequent increase in code enforcement activities in FY 2017-2018, to advise staff and provide transactional legal services related to the Shoreline Development, to advise staff on recent California legislation, and State and Federal litigation and United States Supreme Court decisions that affect varied policy initiatives from the City's sanctuary city status to agency fees charged to public employees, the current contract amount of $657,390 is short $130,000. This resolution would amend the City's legal services agreement with the law firm of Meyers Nave to $787,390 to ensure payables from FY 2017-2018 are covered.

RECOMMENDED ACTION
