Title

RESOLUTION of the City of San Leandro City Council to Accept Grant Funds of $538,926 from the San Francisco Bay Restoration Authority for San Leandro's Treatment Wetland for Pollution Reduction, Habitat Enhancement, and Shoreline Resiliency Project (Project No. RA-007)

 

Body

WHEREAS, the San Francisco Bay Restoration Authority Act, California Government Code §§66700-66706 establishes the San Francisco Bay Restoration Authority (“Authority”) as a regional entity to generate and allocate resources for the protection and enhancement of tidal wetlands and other wildlife habitat in San Francisco Bay and along its shoreline, and authorizes the Authority to award grants to public and private entities to achieve these purposes; and

 

WHEREAS, the Authority awards grants for eligible projects consistent with Government Code §66704.5, the Authority’s Grant Program Guidelines, first adopted in May 2017, and the Authority’s San Francisco Bay Clean Water, Pollution Prevention and Habitat Restoration Measure (‘Measure AA’), passed by the voters in June 2016; and

 

WHEREAS, at its April 11, 2018 meeting, the Authority adopted a resolution authorizing a grant to the City of San Leandro (“grantee”) for the San Leandro Treatment Wetland for Pollution Reduction, Habitat Enhancement, and Shoreline Resiliency, Project No. RA-007 (“the project”).  The resolution was adopted by the Authority pursuant to, and is included in, the Authority’s April 11, 2018 staff recommendation, a copy of which is on file with the grantee and with the Authority; and 

 

WHEREAS, the Authority requires that the governing body of the grantee certify through a resolution that it approves the award of Authority grant funding and authorizes the execution by a representative of the grantee of a grant agreement on terms and conditions required by Authority Grant Agreement No. 007 (the “grant agreement”).

 

 

 

NOW, THEREFORE, be it RESOLVED that the grantee, the City Council of the City of San Leandro, hereby:

 

                     1.                     Approves the award of $538,926 in grant funding from the Authority for the project.

 

                     2.                     Acknowledges that it has or will have sufficient funds to complete the project and to operate and maintain, for the period set forth in the grant agreement, any property acquired, or facilities constructed as a part of the project.

 

                     3.                      Agrees to be bound by all terms and conditions of the grant agreement and any other agreement or instrument as may be required by the Authority and as may be necessary to fulfill the terms of the grant agreement.

 

                     4. Authorizes any of the following named officers or employees of the grantee to act as a representative of the grantee and to negotiate and execute on behalf of the grantee the grant agreement and all other agreements and instruments necessary to complete the project, subject to approval as to form by the City Attorney: Justin Jenson, Water Pollution Control Plant Manager; Debbie Pollart, Public Works Director; Sally Barros, Sustainability Manager; and Jeff Kay, City Manager.
