RESOLUTION of the City of San Leandro City Council to Approve and Authorize the City Manager to Execute a Consulting Services Agreement with Noll & Tam Architects for Design Services for the Mulford-Marina Branch Library, Project 2018.2400; to Authorize the City Manager to Negotiate and Approve Individual Contract Amendments up to 5%; and to Authorize the City Manager to Negotiate and Approve Cumulative Contract Amendments up to 15% of the Original Contract Amount; (Provides for design services for replacement of the existing library with a new facility at the same location)
Body
WHEREAS, an agreement between the City of San Leandro and Noll & Tam Architects, a copy of which is attached, was presented to this City Council; and
WHEREAS, the attached agreement is substantially different from the agreement between the City of San Leandro and Noll & Tam Architects which was approved by Resolution 18-093; and
WHEREAS, the City Council is familiar with the scope of work; and
WHEREAS, the City Manager recommends approval of said agreement.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
• That said agreement is hereby approved and execution by the City Manager is hereby authorized; and
• That the authorization for the agreement pursuant to Resolution 18-093 is superseded by this Resolution; and
• That the City Manager or his designee is authorized to negotiate and approve individual contract amendments up to a maximum of $18,302, which is 5% of the original contract amount; and
• That the City Manager or his designee is authorized to negotiate and approve cumulative contract amendments up to a maximum of $54,907, which is 15% of the original contract amount, for a total not to exceed amount of $420,954; and
• That an original executed agreement shall be attached to and made a part of this resolution.
