RESOLUTION of the City of San Leandro City Council to Authorize a Sole Source Procurement and Approve and Authorize the City Manager to Execute a 5 Year Renewal Contract with Axon Enterprise, Incorporated (Formerly Taser International) for 110 Police Department Body Worn Cameras, 110 TASER Devices, and Continued Subscription Service to a Digital Evidence Management System for a Not to Exceed Amount of $1,367,484, or $262,982 in Fiscal Year 2019-20 and then $276,126 Annually Through Fiscal Year 2023-24.
Body
WHEREAS, the San Leandro City Council approved Resolution No. 2014-040 to purchase 80 body worn cameras and a digital management system subscription by entering into a 5 year contract with Axon Enterprise, Incorporated (formerly Taser International) that expires July 15, 2019; and
WHEREAS, a new 5 year contract between the City of San Leandro and Axon Enterprise, Incorporated (formerly Taser International) was presented to this City Council; and
WHEREAS, the contract upgrades existing hardware and outfits a total of 110 field personnel with body worn cameras, TASER conducted electrical devices, 5 Axon Air licenses, while also continuing the Police Department’s subscription service to Axon’s Digital Evidence Management System; and
WHEREAS, the Police Department fully implemented policies, trained staff, and deployed Axon TASER equipment to all field personnel; and
WHEREAS, a sole source procurement is justified under California Public Contract Code section 3400 for Axon Enterprise, Incorporated because the hardware and services provided by the vendor must align with current training standards for less-lethal use of force and match existing deployed equipment of Police Department field personnel; and
WHEREAS, the City Council is familiar with the contents thereof; and
WHEREAS, the City Manager recommends approval of said agreement.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
1. That in accordance with California Public Contract Code section 3400, the City Council makes a sole source justification to procure all equipment, licensing, and services from Axon Enterprise, Incorporated (formerly TASER International); and
2. That said contract in the amount not to exceed $1,367,484 over a 5 year period is hereby approved and execution by the City Manager is hereby authorized; and
3. That said contract will appropriate funding as follows:

• $85,008 from Fund 688-13-001-5310
• $169,604 from Fund 010-21-001-5310
• $8,370 from Fund 010-21-001-7401
Fiscal Year 2020-2021 (Year #2 Total: $276,126)

4. That the original executed contract shall be attached to and made a part of this legislative file.
