Title

RESOLUTION of the City of San Leandro City Council to Authorize the City Manager to Execute a Non-Professional Services Agreement with Matrix HG, Inc. for Pool Boiler Replacement at the San Leandro Family Aquatic Center (Washington Manor Park) in the Amount of $66,296, and to Negotiate and Approve Cumulative Change Orders up to 25% of the Original Contract Amount

 

Body

WHEREAS, a draft agreement between the City of San Leandro and Matrix HG, Inc. was presented to this City Council; and

 

WHEREAS, the City Council is familiar with the contents thereof; and

 

WHEREAS, Change Orders to modify bid quantities or to respond to unexpected conditions are a normal aspect of public contracting and construction; and

 

WHEREAS, in order to deliver quality public works projects on schedule and within budget, the Council finds that authorizing approval of Change Orders is in the best interests of public health, safety and welfare; and

 

WHEREAS, the City Manager recommends approval of said agreement.

 

NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:

 

1.                     That said agreement substantially in the form presented is hereby approved and execution by the City Manager is hereby authorized; and

 

2.                     That the City Manager is authorized to make non-substantial revisions to said agreement, subject to the approval of the City Attorney; and

 

3.                       That the City Manager or his designee is authorized to negotiate and approve cumulative change orders up to a maximum of $16,574, which is 25% of the original contract amount; and

 

4.  That an original executed agreement shall be attached to and made a part of this resolution.
