RESOLUTION of the City of San Leandro City Council to Accept the Work for the Annual Sidewalk Repair Program 2017-18, Project No. 2017.0060 (provides for accepting the work performed by Sposeto Engineering, Inc., filing the Notice of Completion, releasing the performance and payment bonds, and authorizing release of the warranty bond after one year)

WHEREAS, pursuant to a construction contract between the City of San Leandro and Sposeto Engineering, Inc., approved on March 5, 2018, by Resolution No. 2018-018, Sposeto Engineering, Inc. completed the Annual Sidewalk Repair Program 2017-18, Project No. 2017.0060; and
WHEREAS, said work was completed according to the plans and specifications and to the satisfaction of the Engineering and Transportation Director, who now recommends that said work be accepted.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
1. That the project is accepted; and
2. That the City Clerk is directed to file a Notice of Completion for said project; and
3. That the bonds given for performance and payment of said contract are released when the statute of limitations expires upon recordation of the Notice of Completion; and
4. That upon completion of the one-year warranty period established pursuant to said contract, and to the satisfaction of the Engineering and Transportation Director, the City Manager is authorized to release the maintenance bond provided to warranty the described work.
