RESOLUTION of the City of San Leandro City Council to Authorize the City Manager to Execute Amendment Four to the East Bay Dischargers Authority Joint Exercise of Powers Agreement to Extend the Term of the Agreement to June 30, 2020

WHEREAS, Amendment Four of the agreement between the City and the other members of the East Bay Dischargers Authority Joint Powers Authority, a copy of which is attached hereto and incorporated herein by reference, was presented to the City Council; and
WHEREAS, the Commission of the East Bay Dischargers Authority has approved of said agreement; and
WHEREAS, the City Council is familiar with the contents thereof and desires to continue to be a party to said agreement; and
WHEREAS, Craig Labadie, outside counsel to the City in matters related to this agreement, has reviewed this Resolution and the agreement and recommends the City Council approve this resolution; and
WHEREAS, the City Manager recommends approval of said agreement.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
1. That the City Council authorizes the City Manager to execute the agreement; and
2. That an original executed agreement shall be attached to and made part of this resolution.
