RESOLUTION of the City of San Leandro City Council to Amend Title 5, Chapter 6 of the San Leandro Administrative Code, Amending the Cannabis Product Manufacturing Pilot Program
Body
WHEREAS, California's Medical Cannabis Regulation and Safety Act establishes a comprehensive state licensing system for the commercial cultivation, manufacture, retail sale, testing, and distribution of cannabis and cannabis products; and
WHEREAS, it is in the interest of the City of San Leandro to ensure that Cannabis Product Manufacturing is responsibly established and compatible with other land uses in the City; and
WHEREAS, on June 19, 2017, the City Council of the City of San Leandro adopted Ordinance 2017-014, enabling and regulating cannabis product manufacturing as a conditionally permitted use in conjunction with State licensing requirements; and
WHEREAS, the pilot program established in 2017 under Ordinance 2017-014 included procedures for processing and reviewing up to five Conditional Use Permit applications for Cannabis Product Manufacturing with application processing procedures further defined in the San Leandro Administrative Code under Resolution 2017-082; and
WHERAS, on November 12, 2019, the City Council directed Staff to revisit and eliminate the cap on the number of conditional use permits that could be issued for cannabis product manufacturing; and
WHEREAS, the City Council of the City of San Leandro by the action hereto determines that it is appropriate to discontinue the pilot program limitation on the number of Conditional Use Permits for Cannabis Product Manufacturing; and
WHEREAS, the Amended Title 5, Chapter 6 to the San Leandro Administrative Code is set forth in the attached Exhibit A, incorporated herein by reference.
NOW, THEREFORE, THE CITY COUNCIL FOR THE CITY OF SAN LEANDRO HEREBY RESOLVES THAT:
