RESOLUTION of the City of San Leandro City Council Ratifying the Proclamation of a Local Emergency and a State of Emergency by the Director of Emergency Services

Body
WHEREAS, the Emergency Services Act, California Government Code sections 8558(c) and 8630 authorize the proclamation of a local emergency when conditions of disaster or extreme peril to the safety of persons and property within the territorial limits of a city exist; and

WHEREAS, pursuant to California Government Code section 8630 such an emergency may be proclaimed by the governing body or by an official designated by ordinance adopted by the governing body; and

WHEREAS, subsections (a) and (b) of San Leandro Municipal Code section 3-4-124 provide that the Director of Emergency Services is empowered to proclaim the existence of a "local emergency" if the City Council is not in session; and
WHEREAS, whenever a local emergency is proclaimed by the Director, the City Council shall take action to ratify the proclamation within seven (7) days thereafter or the local emergency will not remain in effect; and

WHEREAS, in accordance with authority granted under the above provisions of state and local law, the Director of Emergency Services beginning on March 16, 2020 did proclaim the existence of a local emergency caused by pandemic in the form of the global spread of a severe acute respiratory illness caused by a novel (new) coronavirus ("COVID-19") including confirmed cases in California, the San Francisco Bay Area, and Alameda County prompting the County to declare a local health emergency and a shelter-in-place order; and

WHEREAS, the City Council does find that the aforesaid conditions were of extreme peril and the City Council could not be convened at the exact time, and that these conditions did warrant and necessitate the proclamation of a local emergency and a state of emergency.
