PLANNING COMMISSION RESOLUTION No. 2021-003, Finding that a Drainage Easement over a Portion of the Dredge Material Disposal Site is in Conformance with the City of San Leandro General Plan.
Body
WHEREAS, The City of San Leandro proposes to allow a drainage easement, 275 feet by 20 feet in area, over the northern portion of the Dredge Material Disposal Site which abuts the Estudillo Canal and is also known as Alameda County Assessor’s Parcel 080G 0910 001 09; and,
WHEREAS, Engineering and Transportation Department staff have found that the easement will serve the public interest as well as the health and safety of the community by permitting diversion of storm water that otherwise may enter the neighborhood to the north of the Estudillo Canal; and,
WHEREAS, in accord with Government Code Section 65402, the Planning Commission of the City of San Leandro considered the proposed drainage easement as it pertains to conformance with the 2035 General Plan at a noticed public hearing.
NOW, THEREFORE IT IS RESOLVED THAT: The forgoing recitals are true and correct and made part of this resolution; and,
BE IT FURTHER RESOLVED THAT: That the proposed action is in conformance with the City of San Leandro General Plan; and,
BE IT FURTHER RESOLVED THAT: The Planning Commission of the City of San Leandro does hereby make the findings and determinations required by San Leandro Administrative Code Section 5.7.100 and California Government Code Section 65402 that the proposed easement is in conformance with the San Leandro General Plan.
