RESOLUTION of City of San Leandro City Council to Approve and Authorize the City Manager to Execute Amendment No. 2 to an Installation Agreement with Climatec, LLC for Design and Construction of Energy-Efficiency and Resiliency Projects at the Water Pollution Control Plant to Increase the Amount of Compensation by $715,445 for a Total Cost of $8,761,226; and to Approve an Appropriation of $715,445 from the Water Pollution Control Plant Fund Balance

WHEREAS, the City of San Leandro and Climatec entered into an energy efficiency and resiliency projects agreement dated December 10, 2020; and
WHEREAS, a contract amendment is required to compensate for an increase in the scope of the work for the design and construction of the energy efficiency and resiliency projects project in the amount of $715,445; and
WHEREAS, Amendment No. 2 to the agreement, a copy of which is attached, was presented to this City Council; and
WHEREAS, the City Council is familiar with the contents thereof; and
WHEREAS, the City Manager recommends approval of said amendment to the agreement.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
1. That for Fiscal Year 2021-2022, an additional appropriation of funds be made from the Water Pollution Control Plant Fund balance in the amount of $715,445 to account 593-52-286-5240; and
2. That said Amendment No. 2 substantially in the form presented is hereby approved and execution by the City Manager is hereby authorized; and
3. That the City Manager is authorized to make non-substantial revisions to said agreement, subject to approval as to form by the City Attorney; and
4. That an original executed agreement shall be attached to and made a part of this resolution.
