Staff Report for a City of San Leandro City Council Resolution Authorizing the City Manager to Enter the City into a Project Funding Agreement with the Alameda County Transportation Commission for $14 Million of Discretionary Funding Provided by Measure BB Transportation Sales Tax Revenue

Staffreport

SUMMARY AND RECOMMENDATIONS

Staff recommends that the City Council approve and authorize the City Manager to enter the City into a Project Funding Agreement with the Alameda County Transportation Commission (Alameda CTC). The agreement will provide $14 Million of Measure BB grant funds for street rehabilitation.

BACKGROUND

On November 4, 2014, the voters of Alameda County, in accordance with the provisions of the Local Transportation and Improvement Act, California Public Utilities Code Section 180000 et seq., approved Measure BB. Measure BB authorized Alameda CTC to administer the proceeds from the extension of an existing one-half of one percent transaction and use tax scheduled to terminate on March 31,2022, and augmentation of that tax by one-half of one percent.

The duration of the tax will be thirty years from the initial year of collection, which began on April 1, 2015, with said tax to terminate/expire on March 31, 2045. The tax proceeds will be used to pay for the investments outlined in the 2014 Alameda County Transportation Expenditure Plan (“2014 TEP”), as it may be amended.  A portion of the annual proceeds is designated for discretionary funding of transportation projects within the County, of which $30 Million has been programmed over five fiscal years for the rehabilitation of San Leandro streets.

The City was previously granted $3,000,000 in discretionary funds for fiscal year 2016-2017. The City was also granted $13,000,000 in discretionary funds for fiscal years 2017-2018 and 2017-2019. Agreements were executed for these grant funds.

As the City has now been granted the remaining $14,000,000 in discretionary funds for fiscal years 2019-2021, a new project agreement that sets forth the terms and conditions of the grant must be executed before the City is eligible to receive the funds. Costs incurred against this agreement starting from May 1, 2021, are eligible for reimbursement.

Analysis

The terms and conditions of the grant are customary, and the City can comply without hardship. Alameda CTC will permit the use of the City’s Local Business Ordinance, as well as the City’s Community Workforce Agreement on contracts funded by the grant.

The agreement attached to the resolution is substantially complete; however, minor changes to the language, subject to approval as to form by the City Attorney, may occur.

Applicable General Plan Policies

Policy T 5.3: Maintenance: Regularly maintain City streets and traffic control devices to ensure that streets operate safely and efficiently. The City will strive for an overall Pavement Condition Index of 76, which is the lower limit of industry best practices.

Legal Analysis

The City Attorney’s Office reviewed the agreement, and it is approved as to form.

Fiscal Impacts

The execution of the agreement will provide $14 Million for the rehabilitation of City streets. There is no matching fund requirement.
