RESOLUTION of the City of San Leandro City Council to Authorize the City Manager to Enter into a Project Funding Agreement with the Alameda County Transportation Commission for Grant Funding for Class IV Protected Bike Lanes on Hesperian Boulevard and Fairmont Drive; and to Appropriate $1,479,000 in Grant Funds (provides for an agreement with the Alameda County Transportation Commission for $1,479,000 of grant funds for the design and installation of Class IV Protected Bike Lanes)

WHEREAS, Alameda County Transportation Commission ("Alameda CTC") administers funding programs consisting of 2000 Measure B, 2010 Vehicle Registration Fee, 2014 Measure BB, CMA-TIP, and Transportation Fund for Clean Air Programs for projects and programs that benefit the Alameda County transportation system, and such funding is collectively defined as and shall be referenced herein as the "Alameda CTC Administered Funds" and

WHEREAS, City of San Leandro ("fund Recipient") submitted a funding application to the Alameda County Transportation Commission ("Alameda CTC") requesting $1,479,000 funding for Class iv Protected Bike Lanes on Hesperian Blvd and Fairmont Dr ("project") from the Alameda CTC's programming and allocation process of Alameda CTC's administered fund sources; and

WHEREAS, the project will upgrade the existing Class IV bike lanes to physically separated class iv bike lanes using barriers along Hesperian Boulevard, between Fairmont Dr and Springlake Dr, and along Fairmont Drive, between Hesperian Bl and E.14th Street; and
WHEREAS, Alameda CTC awarded $1,479,000 in Alameda CTC Administered Funds for the implementation and delivery of the project to the Fund Recipient; and
WHEREAS, as part of the requirements to receive Alameda CTC Administered Funds awarded to the Project, Alameda CTC requires a resolution adopted by the responsible funding recipient stating the following:

1. Commitment of Fund Recipient's matching funds against the awarded Alameda CTC Administered Funds; and
2. Confirmation of Fund Recipient understanding that the amount of Alameda CTC Administered Funds awarded to the Project is capped at the amount awarded by Alameda CTC, and therefore any cost increase cannot be expected to be funded with additional Alameda CTC Administered Funds; and
3. Confirmation Fund Recipient shall complete the project as described in the funding application and the subsequent funding agreement between Alameda CTC and the Fund Recipient; and
4. Confirmation Project will comply with all the project-specific requirements set forth in the Alameda CTC Project Funding Agreement "Agreement".

WHEREAS, the City Council is familiar with the contents thereof, and the City Manager recommends approval of the project agreement.

NOW, THEREFORE, the City of San Leandro City Council hereby RESOLVES as follows:

1. That the City of San Leandro agrees to accept award of $1,479,000 in Alameda CTC administered funds; and

2. That said agreement substantially in the form presented is hereby approved and execution by the City Manager is hereby authorized; and

3. That the project will be implemented as described in the application, Agreement, and in this Resolution; and

4. That there is no pending or threatened litigation that might in any way adversely affect the fund recipient's ability to implement and deliver the proposed project; and

5. That $1,479,000 of grant funds are appropriated for the subject project to Account No. 150-38-423-5240; and

6. That the authorization of match funds in the amount of $504,000 from existing appropriation is hereby authorized; and

7. That the City Manager is authorized to make non-substantial revisions to said agreement, subject to approval as to form by the City Attorney; and

8. That an original executed agreement shall be attached to and made a part of this resolution.
