RESOLUTION of the City of San Leandro City Council to Approve and Authorize the City Manager to Execute Amendment No. 1 to a Consulting Services Agreement with SWCA Environmental Consultants for On-Call Planning Services by $115,000 to an Amount Not to Exceed $150,000 (to be Fully Cost Recoverable Through Applicable Developer Planning Fees)

WHEREAS, following a competitive selection process, the City Council approved Resolution No. 2020-057 authorizing SWCA Environmental Consultants (“Consultant”) to enter into Professional Services Agreements with the City of San Leandro (“City”); and
WHEREAS, on July 27, 2021 the City entered into a Consulting Services Agreement with SWCA Environmental Consultants for on-call planning services for a maximum not to exceed amount of $35,000.00; and
WHEREAS, the City seeks to amend the Consulting Services Agreement by $115,000 to increase the available funding to an amount not to exceed $150,000.00 and extend the contract end date by 12 months from June 30, 2022 through June 30, 2023; and
WHEREAS, an amendment to the agreement between the City of San Leandro and SWCA Environmental Consultants, a copy of which is attached and incorporated herein, is presented to this City Council; and
WHEREAS, the City Council is familiar with the contents thereof; and
WHEREAS, the City Manager recommends approval of said agreements.
NOW, THEREFORE, the City Council of the City of San Leandro hereby RESOLVES as follows:
1. That the amendment at the not to exceed amount of $150,000.00 is approved and the City Manager is authorized to execute Amendment No. 1 to the Consultant Services Agreement with SWCA Environmental Consultants for On-Call Planning Services to be provided on an as-needed basis; and
2. That the firm will be compensated for their work through a deposit paid to the City by project applicants; and
3. That the firm will provide planning and staffing services on behalf of the City of San Leandro; and
4. That an appropriation of $150,000 for Fiscal Year 2021-22 from the General Fund Undesignated Fund Balance into Account 010-41-001-5120 to cover this contractual obligation is hereby authorized;
5. That the Fiscal Year 2022-23 budget will be increased by the balance of $150,000, less any direct expenditures incurred for this project, that remains at the close of Fiscal Year 2021-22; and that the exact project balance, as determined by the Finance Department, shall be appropriated into Account 010-41-001-5120 for Fiscal Year 2022-23;
6. That the City Manager or her designee is hereby authorized to negotiate and approve cumulative amendments to the agreement up to a maximum of 25% of the amended contract amount provided that the amended amounts are available in the project deposit account; and
7. That the City Manager is authorized to make non-substantial revisions to said agreement amendment, subject to the approval of the City Attorney; and
8. That an original executed agreement amendment shall be attached to and made a part of this resolution;
