Resolution to Authorize the City Manager to Submit Applications for the CalRecycle Rubberized Pavement Grant Program

SUMMARY AND RECOMMENDATIONS
Staff recommends that the City Council authorize the City Manager to submit applications for the CalRecycle Rubberized Pavement Grant Program, which will be utilized to partially fund the use of rubberized chip sealing and rubberized asphalt concrete on future road Capital Improvement Program projects.
BACKGROUND
The attached authorizing resolution is needed for the City to receive funding from the latest Rubberized Pavement Grant from CalRecycle. CalRecycle issues a call-for-projects for its Rubberized Pavement Grant Program approximately once every year and is part of CalRecycle’s efforts to recycle and reuse solid waste that would otherwise end up in California landfills. One hundred percent of the waste tires used to create the rubberized asphalt materials used by this Program are generated in California. Each ton of asphalt binder material contains at least 300 pounds of tire-derived crumb rubber, or 15% by weight.
The Rubberized Pavement Grant Program consists of two components. The first component is for rubberized asphalt concrete (RAC), which reimburses local agencies for a portion of the cost per ton for the installation of RAC. The RAC reimbursement rate for the latest round of the Rubberized Pavement Grant depends on how many times a local agency had previously received a grant for the use of RAC. The City of San Leandro previously received two Rubberized Pavement Grants that included the use of RAC, so the reimbursement rate for the latest grant cycle will be $14 per ton of RAC installed. The second component is for utilization of rubberized chip sealing, which has a reimbursement rate of $1 per square yard of rubberized chip sealing installed.
The City applied for the Fiscal Year 2021-2022 cycle of the Rubberized Pavement Grant Program in September 2021. CalRecycle notified the City in mid-December 2021 that they did not have enough funding to award a grant to the City of San Leandro. However, CalRecycle notified the City on April 13, 2022 that it is able to award a FY 2021-2022 Rubberized Pavement Grant to the City due to reallocated monies.
In 2010, asphalt rubber chip seal was used for the first time in San Leandro as part of the Annual Street Sealing 2009-2010 Project and was used on subsequent projects with satisfactory results. The City previously received five CalRecycle Rubberized Pavement Grants that were applied toward multiple Capital Improvement Program road projects.
Analysis
The Rubberized Pavement Grant Program, if awarded to the City, will help pay for materials used for paving should the City decide to incorporate asphalt rubber in its annual street paving project. The grant will also pay for some materials used in rubberized cape seal. Although rubberized materials cost more than their conventional counterparts, they are more durable and do a better job of resisting reflective cracking. The grant program allows rubberized materials to be cost competitive with traditional asphalt materials. Free technical support is included as part of the Rubberized Pavement Grant Program, to provide assistance during the design and construction phases to ensure proper installation and successful projects.
Current Agency Policies
• The application and utilization of CalRecycle grant funding for road projects is consistent with the 2021 City Council goal to maintain and enhance San Leandro's infrastructure.
Previous Actions
• On March 7, 2011, the City Council by Resolution No. 2011-055 authorized the City Manager to file an application for the CalRecycle Rubberized Asphalt Concrete Grant Program for five years commencing on the resolution adoption date.
• On November 21, 2016, the City Council by Resolution No. 2016-157 authorized the City Manager to file an application for the CalRecycle Rubberized Asphalt Concrete Grant Program for five years commencing on the resolution adoption date.
Applicable General Plan Policies
• This action is consistent with Transportation Policy T-5.3 of the General Plan for regular maintenance of City streets and Action Item T-5.3.A: Funding for Maintenance.
Summary of Public Outreach Efforts
• The bid advertisement of future road projects will be advertised in multiple languages in various newspapers.
• Residents and businesses directly impacted by the future roadwork will be notified in writing by the contractor of the work to be done, schedule, and the contact information of key project staff.
Fiscal Impacts
The FY 2021-2022 Rubberized Pavement Grant will pay for $14 of every ton of rubberized asphalt concrete installed during the grant term and $1 for every square yard of rubberized chip sealing. The grant term will expire on April 1, 2024, and will be used to partially reimburse the City for future roadwork projects that will utilize materials containing recycled tires.
The specific locations where this grant will be applied are not yet determined. They will be the streets that will be repaved with rubberized asphalt concrete or sealed with rubberized chip sealing during the construction seasons in 2022 and 2023.
Budget Authority
As the Rubberized Pavement Grant Program does not require matching funds, no additional funds are needed if the City receives this grant funding.
