SUMMARY AND RECOMMENDATIONS

City of San Leandro Charter Section 250 provides that a vacancy in the office of Council Member shall be filled by appointment by the Council. If the Council fails to fill such vacancy within sixty days after its existence, the Council shall call a special election, at which the unexpired remainder of the term of such office shall be filled by the voters.

BACKGROUND
City of San Leandro Charter Section 250 provides the method by which a vacancy in the office of Council Member or Mayor shall be filled, which is by appointment by the Council. If the Council fails to fill such vacancy within sixty days after its existence, the Council shall call a special election, at which the unexpired remainder of the term of such office shall be filled by the voters. Charter Section 605 provides that the Council may, and when required by law shall, call special municipal elections for such purposes as are required by law or as the Council may prescribe. A special municipal election may be held on any date specified by the Council. In accordance with Charter Section 250, the...
