TITLE
Ordinance No. 2011-014, an Ordinance Amending Article 1, Chapter 5-1 of Title 5 of the San Leandro Municipal Code Establishing a Bicycle Rack Program

BODY
WHEREAS, the City of San Leandro recognizes that the installation of bicycle parking racks improves San Leandro’s transportation infrastructure and enhances San Leandro’s image as a livable, innovative city; and

WHEREAS, there is a need to provide parking for the increasing number of people who choose bicycling as a transportation option.

NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as follows:

Section 1. The purpose is to establish regulations for placing bicycle racks within the public right-of-way.

Section 2. Chapter 5-1 of the City of San Leandro Municipal Code is hereby amended by the addition of Article 1 as follows:

5-1-100 (a) (11) Placing street furniture, including bicycle racks, within the public right-of-way.

Section 3. Chapter 5-1 ARTICLE 6. MISCELLANEOUS Section 5-1-645 of the City of San Leandro Municipal Code is hereby is revised as follows:

5-1-645 BICYCLE RACKS.
Bicycle racks shall not be placed in the City-owned right-of-way without permission from the Public Works Director or his designee. Permitted bicycle racks shall be installed following the regulations specified in Title 8 Chapter 12 of the San Leandro Administrative Code.

Section 4. Chapter 5-1 ARTICLE 6 MISCELLANEOUS of the City of San Leandro Municipal Code is hereby amended to include the following:

5-1-650 ENFORCEMENT.
The Public Works Director is designated as the enforcement authority for purposes of enforcing the provisions of this Chapter.

Section 5. Effective Date and Publication.

This ordinance shall take effect thirty (30) days after adoption. The City Clerk is directed to publish the title once and post a complete copy thereof on the City Council Chamber bulletin board for five (5) days prior to adoption.
